Can You Notarize Your Own Documents?

A notary commission does not turn a personal signature into something a notary can certify alone. The seal, certificate and commission exist to record an impartial notarial act involving another signer.

Florida Does Not Allow Self-Notarization

Florida law states that a notary public cannot notarize his or her own signature. The rule applies even when the signature is genuine and the document seems routine. A personal affidavit, authorization form or business record does not become eligible simply because the notary knows the signer’s identity.

Self-notarization defeats the independent role of the office. The same individual would be the signer, identity checker and certifying official. Florida treats this seriously. Section 117.05 lists notarizing one’s own signature as unlawful.

Ownership Creates Another Problem

The wording “own document” can be misleading. A document may belong to a notary without carrying that notary’s signature. Even then, Florida prohibits a notary from handling a signature when the notary is a party to the underlying transaction or holds a financial interest in it.

For example, a notary should not certify another person’s signature on the notary’s private sales agreement when the notary receives the payment. A neutral commissioned notary should complete the act instead.

An employee may notarize for an employer when employment is the only connection and no separate benefit is received beyond salary and the legally permitted notary fee. That exception does not make personal transactions acceptable.

Family Signatures Also Have Limits

Florida notaries may not notarize signatures for a spouse, parent or child. The restriction covers a mother, father, son and daughter. Other relatives are not listed in that specific rule, but financial interest or involvement in the transaction can still create a conflict.

What a Notary Actually Confirms

Prepare for a Separate Notary

The document should be complete before the appointment. Blank spaces, missing pages or an unclear certificate can stop the process. The signer should avoid signing early when a jurat is required because the oath and signature must occur as part of the notarial act.

Acceptable identification should be ready. The name on the document should reasonably match the identification presented. Witness requirements should be confirmed with the receiving party because notarization does not automatically replace witnesses.

A commissioned notary seeking notarization is treated as an ordinary signer during the appointment. The other notary checks identity, observes the required act and completes the certificate with an independent seal.
